Professional and Content Submission Terms

1. Who these Professional Terms apply to

These Professional Terms apply to all builders, developers, builder representatives, brokers, sales agents, referral agents, teams, photographers, marketing vendors, property owners, contract holders, wholesalers, content creators, and other professional or commercial users who access, post, submit, advertise, receive consumer inquiries, manage content, or use professional features through 4me (each a 'Professional User').

2. Relationship to consumer Terms

These Professional Terms supplement the 4me Terms of Use, Privacy Policy, Disclaimers, DMCA Policy, Fair Housing Policy, and any written agreement between you, your broker, your company, Bison Creek Real Estate LLC, Ruben Vela Jr., 4me, or other participating parties. If there is a conflict, the more specific signed written agreement controls, followed by these Professional Terms, followed by the general Terms of Use.

3. Authority to post

You may post or submit property or builder content only if you have authority to do so. Depending on the content, authority may require:

ownership or written authorization from the property owner, builder, developer, or seller;

broker approval and compliance with brokerage advertising policies;

listing-agent/listing-broker approval;

MLS permission or data-license rights for MLS-derived content;

photographer, videographer, architect, designer, floor-plan, logo, and trademark rights;

seller authorization for coming-soon, off-market, pocket, delayed-marketing, or private listing content;

builder authorization for community, inventory, floor-plan, incentive, and model-home content; and

contract/equitable-interest disclosure where you are assigning a contract rather than selling title.

4. Agent and broker compliance

If you are a licensed real estate professional, you are responsible for maintaining an active license, acting only through your sponsoring broker where required, complying with TREC, MLS, NAR, local association, brokerage, advertising, compensation, privacy, fair-housing, and consumer-protection rules, and obtaining broker approval before posting or advertising.

Every agent or broker profile and advertisement must include required license-holder and broker information. Do not use 4me branding, titles, URLs, profiles, or content in a way that implies you operate a brokerage independently from your sponsoring broker, or that 4me is your broker, unless a written and legally approved structure says so.

5. Builder and developer compliance

If you post as a builder, developer, new construction sales team, or builder representative, you represent that you are authorized to submit and update the content and that you have the right to grant 4me permission to display it. If an unlicensed builder representative communicates with consumers, that person is responsible for ensuring that any license exemption or legal authority applies. 4me and Bison Creek Real Estate LLC do not supervise builder employees or representatives unless a separate written agreement says otherwise.

6. Content rights and license to 4me

You represent and warrant that you own or have all rights needed for every photo, video, rendering, floor plan, map, logo, text, description, incentive, price, listing field, document, review, rating, and other content you submit. You grant 4me and the Protected Parties a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, format, display, publish, distribute, promote, advertise, syndicate, make derivative works from, and otherwise use the content in connection with the Platform, marketing, social media, emails, analytics, and related services.

7. No scraped or unauthorized content

Do not submit content scraped or copied from Zillow, Realtor.com, Redfin, NewHomeSource, ShowingNew, MLS systems, builder websites, broker websites, photographer sites, social media, or other third-party sources unless you have express permission or a valid license. Screenshots, watermarked images, copied listing remarks, unauthorized MLS photos, and copied floor plans are prohibited.

8. Accuracy and updates

You are responsible for the accuracy, completeness, and timeliness of content you submit. You must promptly update or remove content that becomes unavailable, sold, withdrawn, leased, expired, stale, inaccurate, misleading, unauthorized, or noncompliant. Prices, incentives, lot releases, completion dates, and availability must include expiration dates or 'subject to change' disclaimers where appropriate.

9. New construction and builder content standards

Builder and new construction posts should clearly disclose, where applicable:

builder or developer name;

community name and city;

whether a home is quick move-in, to-be-built, model, plan, lot, or representative only;

starting price versus specific-home price;

incentive terms, expiration date, and lender/title conditions;

estimated completion date and whether it is guaranteed;

whether images show options/upgrades/not-included features;

HOA, MUD, PID, tax-rate, school, and amenity information as estimates only unless verified;

buyer-agent/co-broker registration requirements if disclosed; and

builder contract, warranty, and inspection disclaimers.

10. MLS, IDX, coming-soon, and off-market content

Do not post MLS-only data, private remarks, showing instructions, lockbox codes, non-public MLS data, copyrighted MLS photos, or listing information unless your broker, MLS, and data license allow it. If you publicly market a listing, coming-soon listing, private listing, office exclusive, delayed-marketing listing, or off-market property, you are responsible for complying with seller instructions, brokerage policy, MLS rules, NAR policies if applicable, and state law.

11. Assignment and equitable-interest content

If you post an assignment, wholesale, option, contract interest, or equitable-interest opportunity, you must clearly disclose that you are assigning a contract or equitable interest and may not own legal title. You must not imply you are the owner, listing broker, or seller unless true and authorized. Uploading proof of authority may be required. 4me may reject or remove assignment posts that appear misleading, incomplete, or noncompliant.

12. Consumer inquiries, referrals, and consumer communications

Consumer information received through 4me may be used only for the purpose for which it was provided and in compliance with the Privacy Policy, applicable consent language, brokerage policy, and law. Do not sell, resell, scrape, export, spam, or misuse consumer information. Do not contact consumers by automated calls/texts or marketing messages without legally sufficient consent.

Referral fees, commissions, and brokerage compensation must be handled through properly licensed brokers and written agreements where required. Do not pay or accept referral fees or brokerage compensation through unlicensed individuals or unapproved entities.

13. Fair housing and advertising standards

All Professional Users must follow fair-housing laws. Content and targeting must focus on property facts, features, location, price, and lawful amenities - not protected characteristics or assumptions about who should live there. 4me may remove content that references protected classes, expresses preferences or exclusions, targets housing ads in a discriminatory way, or otherwise creates fair-housing risk.

14. No misleading professional claims

Do not claim rankings, awards, certifications, licensing status, builder relationships, exclusive access, guaranteed incentives, guaranteed returns, guaranteed appreciation, guaranteed low rates, or other credentials unless accurate, current, substantiated, objective, and legally permissible. Do not use titles such as CEO, owner, president, brokerage, company, or associates in a way that violates broker or advertising rules.

15. Reviews, ratings, and testimonials

Reviews and testimonials must be truthful, based on actual experiences, and must disclose material connections or compensation where required. Do not post fake reviews, suppress negative reviews deceptively, or use testimonials that create misleading impressions about results, incentives, or outcomes.

16. Indemnity by Professional Users

You agree to indemnify, defend, and hold harmless the Protected Parties from all claims, disputes, losses, liabilities, penalties, fines, damages, and expenses, including reasonable attorneys' fees, arising from or related to your content, your professional services, your advertising, your consumer communications, your failure to obtain rights or authority, your violation of MLS/broker/TREC/fair-housing/privacy/IP/TCPA/consumer-protection rules, your inaccurate information, or your payment/referral arrangements.

17. Removal, suspension, and audit rights

4me may reject, edit, label, de-rank, remove, suspend, or disable content, accounts, consumer inquiries, referral activity, or professional features at any time if we believe content is inaccurate, stale, unauthorized, infringing, discriminatory, risky, noncompliant, or harmful. We may require proof of license, broker approval, builder authorization, content rights, seller consent, contract interest, or consumer consent.

18. Independent parties

Unless a signed written agreement says otherwise, Professional Users are independent parties and not employees, partners, agents, joint venturers, franchisees, or representatives of 4me, Bison Creek Real Estate LLC, Ruben Vela Jr., or other participating brokers/agents. Each Professional User is responsible for their own professional conduct, clients, advertising, compliance, taxes, insurance, licensing, and records.
