Terms of Use
1. Acceptance of these Terms
These Terms of Use (the 'Terms') govern your access to and use of 4me.house, forme.house, and any related websites, mobile features, landing pages, social pages, email, text, advertising, CRM, electronic signature, and marketing tools that link to these Terms (collectively, the 'Platform'). By accessing the Platform, creating an account, submitting a form, saving a home, requesting information, requesting a tour, uploading content, or clicking to accept these Terms, you agree to these Terms. If you do not agree, do not use the Platform.
We may update these Terms from time to time. The latest version will be posted on the Platform. Your continued use after an update means you accept the updated Terms.
2. Who we are
The Platform is a Central Texas new construction home search and real estate marketing service operated under the 4me brand. Brokerage services made available through the Platform are provided by Bison Creek Real Estate LLC, with Ruben Vela Jr. as a sponsored sales agent, and/or other participating licensed brokers and agents, as disclosed on the relevant page or communication.
Unless expressly stated in a signed written agreement, 4me is not a separately licensed real estate brokerage, mortgage lender, title company, inspector, builder, contractor, attorney, tax advisor, appraisal company, or insurance provider. Other brokers, agents, builders, developers, lenders, inspectors, title companies, and service providers that appear on or communicate through the Platform are independent from 4me and from each other unless a written agreement says otherwise.
3. Protected parties
For purposes of disclaimers, limitations of liability, indemnity, and release provisions, the 'Protected Parties' include 4me, the Platform, Bison Creek Real Estate LLC, Ruben Vela Jr., any sponsoring or participating brokerages, brokers, agents, referral agents, builders, developers, vendors, technology providers, affiliates, owners, officers, members, employees, contractors, representatives, successors, assigns, and approved advertising or data partners, to the fullest extent allowed by law.
4. Real estate agency and representation
Use of the Platform, browsing homes, saving homes, submitting an inquiry form, receiving automated matches, communicating with Ruben Vela Jr., communicating with a builder, or communicating with a participating agent does not, by itself, create a broker-client relationship, agency relationship, fiduciary relationship, representation agreement, or exclusive relationship.
A broker-client relationship is created only through a written representation agreement or other signed written agreement approved by the applicable broker. For Texas residential buyer services, the required written agreement must be in place before any residential property is shown or before an offer is presented, as applicable. If you are already represented by another broker or agent, you must disclose that relationship before requesting services through the Platform. The Platform is not intended to interfere with existing listing agreements, buyer representation agreements, builder registration rights, or broker-client relationships.
5. Brokerage services and referrals
If you request real estate services, your request may be handled by Ruben Vela Jr., Bison Creek Real Estate LLC, or a participating licensed broker or agent. If 4me, Ruben Vela Jr., or Bison Creek Real Estate LLC refers you to another broker or agent, the receiving broker or agent may pay a referral fee or other compensation to the referring brokerage if a transaction closes, as permitted by law and the applicable broker-to-broker agreement. Referral compensation is generally paid through the brokers involved and not directly to unlicensed persons or unapproved entities.
You are not required to use any particular broker, agent, builder, lender, title company, inspector, insurance provider, or settlement service provider as a condition of using the Platform, unless a separate lawful written agreement states otherwise.
6. New construction and builder information
The Platform may display new construction communities, floor plans, quick move-in homes, model homes, lot releases, incentives, builder events, and other new construction information. This information may be provided by builders, developers, builder representatives, brokers, agents, data providers, public sources, or manual research.
Prices, incentives, rate buydowns, closing-cost offers, availability, completion dates, square footage, lot sizes, tax estimates, HOA dues, MUD/PID assessments, school information, amenities, included features, options, elevations, floor plans, renderings, photos, videos, model-home features, and community details are subject to change without notice and may be incomplete, estimated, representative, or inaccurate. You must verify all information directly with the builder, developer, applicable broker, municipality, school district, taxing authority, HOA, lender, inspector, surveyor, title company, and your own professionals before relying on it.
7. Builder registration and buyer-agent compensation
Builders often have their own registration, co-broker, commission, incentive, contract, and visit policies. Visiting a model home, contacting a builder directly, registering online, or failing to identify your agent before first contact may affect whether a buyer-agent commission, referral fee, incentive, or representation arrangement is available. 4me, Ruben Vela Jr., and Bison Creek Real Estate LLC do not guarantee that any builder will pay buyer-agent compensation or honor a registration. Always consult your agent before contacting or visiting a builder if you want representation.
8. Property information is not guaranteed
All property, community, builder, school, tax, price, payment, incentive, financing, neighborhood, commute, square footage, acreage, flood, HOA, MUD, PID, and availability information is provided for general informational and discovery purposes only. It is not a substitute for due diligence, inspection, title review, survey review, tax review, lender review, legal advice, or advice from your own licensed professionals.
No Protected Party guarantees the accuracy, completeness, timeliness, reliability, legality, merchantability, fitness, investment performance, future value, or suitability of any property, builder, listing, incentive, or content shown on or through the Platform.
9. Future MLS, IDX, and data-feed content
The Platform may later include MLS, IDX, VOW, syndication, broker, builder, or third-party data feeds. If MLS or IDX information appears, it will be subject to the rules, disclaimers, usage limits, and attribution requirements of the applicable MLS, broker, data provider, and licensing agreement. MLS/IDX data is typically for consumers' personal, non-commercial use to identify prospective properties of interest and may not be reproduced, redistributed, scraped, mined, or used for any unauthorized purpose.
10. Accounts and security
You may need an account to save homes, create boards, request tours, sign documents, upload content, or use certain features. You agree to provide accurate information, keep your login credentials confidential, promptly update your information, and notify us of unauthorized account use. You are responsible for activity that occurs through your account unless caused solely by our gross negligence or willful misconduct.
11. Permitted use
You may use the Platform for your personal home search, new construction comparison, lawful real estate inquiry, authorized professional advertising, broker-approved referral activity, and other lawful purposes permitted by these Terms. Consumer users may not use the Platform for commercial copying, resale, data mining, scraping, unauthorized inquiry harvesting, competitive database creation, or unauthorized display of listing or builder content.
12. Prohibited conduct
You agree not to:
scrape, crawl, spider, data mine, harvest, copy, frame, mirror, bulk download, or create a competing database from Platform content;
post or upload content you do not own or lack permission to use, including MLS photos, builder images, floor plans, videos, logos, remarks, screenshots, copyrighted forms, or portal data;
post inaccurate, misleading, fake, stale, discriminatory, harassing, unlawful, obscene, deceptive, or infringing content;
represent that you are a broker, agent, builder, owner, contract holder, or authorized representative if you are not;
interfere with another broker-client relationship, builder registration, listing agreement, or representation agreement;
use the Platform for illegal steering, discriminatory advertising, or targeting based on protected characteristics;
send spam, unlawful calls/texts/emails, malware, phishing messages, or unauthorized marketing;
circumvent access controls, misuse electronic signatures, impersonate anyone, or attempt unauthorized access to the Platform; or
use the Platform in a way that violates TREC rules, MLS rules, fair-housing laws, privacy laws, intellectual-property laws, consumer-protection laws, advertising rules, or any applicable law.
13. User and professional content
If you post, upload, submit, message, review, rate, comment, send, or otherwise provide content through the Platform ('User Content'), you represent and warrant that you have all rights, licenses, consents, and authority needed to provide that content and allow us to use it. You remain responsible for your content.
You grant the Protected Parties a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, reproduce, display, publish, distribute, adapt, format, create derivative works from, promote, and use your User Content in connection with operating, improving, advertising, and providing the Platform and related real estate services. This license ends when you remove the content, except where the content has been shared, archived, used in records, required for legal compliance, or incorporated into materials already created.
14. Professional users, builders, brokers, and agents
If you use the Platform as a builder, developer, broker, sales agent, referral agent, team, vendor, content creator, photographer, or other professional user, you also agree to the 4me Professional and Content Submission Terms, if posted or provided. You are responsible for your own license status, broker approval, advertising compliance, source-of-data rights, consumer consents, privacy obligations, recordkeeping, compensation disclosures, and content accuracy.
15. Communications and consent to contact
By submitting your name, phone number, email address, property preferences, tour request, saved-home request, document request, builder inquiry, or other information through the Platform, you authorize 4me, Ruben Vela Jr., Bison Creek Real Estate LLC, assigned or referral brokers/agents, and the specific builder/developer/community or service provider you selected or requested to contact you about your inquiry, real estate services, homes, tours, buyer representation, new construction, financing options, and related services by email, phone, text message, direct message, or similar methods, including using automated technology where permitted by law.
Consent is not required to purchase property or services. Message and data rates may apply. Reply STOP to text messages to opt out of texts. Use unsubscribe links to opt out of marketing emails. You may revoke consent by contacting [email protected]. Administrative, transactional, legal, or account-related messages may still be sent as permitted by law.
16. Electronic records and signatures
If you choose to use electronic records or electronic signatures through the Platform or an integrated third-party electronic signature provider, you agree to the Electronic Records and Signature Consent provided to you. Your electronic signature, initials, click, checkbox, typed name, drawn signature, selected signature, or similar action may have the same legal effect as a manual signature or initials. Some documents may not be eligible for electronic signature, and you may request paper copies or withdraw consent as described in the Electronic Records and Signature Consent.
17. No legal, tax, lending, investment, inspection, appraisal, or construction advice
The Platform may provide educational content, checklists, estimates, calculators, market commentary, property comparisons, builder information, payment scenarios, or general guidance. This content is for informational purposes only and is not legal, tax, financial, investment, mortgage, insurance, appraisal, inspection, engineering, construction, title, survey, accounting, or professional advice. Consult qualified professionals for your specific situation.
18. Third-party services and links
The Platform may contain links, embeds, feeds, maps, payment tools, CRM tools, electronic signature tools, MLS/data tools, social sharing tools, lender calculators, builder pages, or other third-party services. We do not control and are not responsible for third-party services, content, availability, privacy practices, terms, errors, outages, security, or acts. Your use of third-party services may be governed by their separate terms and policies.
19. Fair housing and equal opportunity
All housing-related content and advertising on the Platform must comply with the Fair Housing Act and all applicable federal, state, and local fair-housing laws. We do not knowingly accept or allow advertising or content that indicates a preference, limitation, exclusion, or discrimination based on race, color, religion, sex, familial status, national origin, disability, or any other protected class under applicable law. We may remove content, suspend users, or report activity that appears discriminatory or unlawful.
20. Copyright, trademarks, and DMCA
All Platform content, branding, layout, designs, software, databases, text, graphics, logos, and other materials are owned by 4me or its licensors unless otherwise stated. Third-party marks and content belong to their respective owners. No rights are granted except as expressly stated in these Terms.
If you believe content on the Platform infringes your copyright, send a notice to [email protected] with the information described in our DMCA Copyright Policy. We may remove content and terminate repeat infringers.
21. Availability, changes, and termination
We may modify, suspend, restrict, or discontinue any part of the Platform at any time. We may remove content, refuse service, suspend accounts, terminate access, or preserve records where we believe doing so is necessary to protect users, comply with law, enforce these Terms, protect content rights, address security issues, avoid liability, or maintain the Platform.
22. Disclaimers
The Platform and all content, services, listings, data, tools, communications, and features are provided 'as is,' 'as available,' and 'with all faults.' To the fullest extent permitted by law, the Protected Parties disclaim all warranties, express or implied, including warranties of accuracy, reliability, completeness, title, non-infringement, merchantability, fitness for a particular purpose, quiet enjoyment, uninterrupted service, security, results, habitability, construction quality, investment performance, or future property value.
23. Limitation of liability
To the fullest extent permitted by law, the Protected Parties will not be liable for indirect, incidental, special, consequential, exemplary, punitive, lost-profit, lost-data, lost-opportunity, business interruption, diminution-in-value, reliance, delay, inaccuracy, or similar damages arising from or related to your use of or inability to use the Platform, property information, builder content, referrals, electronic records, third-party services, or user content, even if advised of the possibility of damages.
To the fullest extent permitted by law, any aggregate liability of the Protected Parties arising from or related to the Platform will not exceed the greater of (a) the amount you paid directly to 4me for Platform access in the twelve months before the claim or (b) $100. This limitation does not limit liability that cannot be limited by law.
24. Indemnification
You agree to indemnify, defend, and hold the Protected Parties harmless from and against all claims, disputes, liabilities, damages, losses, costs, fines, penalties, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Platform, your content, your violation of these Terms, your violation of law, your infringement of rights, your professional services, your unauthorized use of property/listing/builder/MLS content, your communications with consumers, or your failure to obtain required consents, permissions, approvals, licenses, or authorizations.
25. Governing law; dispute terms; jury waiver
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. any dispute arising from or related to these Terms or the Platform will be brought in the state or federal courts located in Bell County, Texas, unless a different venue, arbitration clause, or dispute process is required by an applicable agreement or law. To the fullest extent permitted by law, you and we waive any right to a jury trial for disputes arising from or related to these Terms or the Platform.
26. Miscellaneous
These Terms, together with any posted policies or written agreements that apply to your use of the Platform, are the entire agreement between you and us regarding Platform use. If any provision is unenforceable, the remaining provisions remain in effect. We may assign these Terms in connection with a merger, sale, reorganization, or transfer of assets. You may not assign these Terms without our written consent. No waiver is effective unless in writing. Headings are for convenience only.

SMS/Text Messaging Program Terms
The 4me.house messaging program is operated by Ruben Vela, a licensed Texas real estate sales agent with Bison Creek Real Estate LLC. It sends property listing alerts, home recommendations, open-house information, showing and appointment coordination and confirmations, account and transaction updates, and related marketing to individuals who provide their mobile number and opt in through our forms, account settings, or by texting us. By opting in, you represent that you are the owner or authorized user of the mobile number provided.
Message frequency varies. Message and data rates may apply. To stop messages at any time, reply STOP; you will receive one confirmation message and no further messages. For help, reply HELP or contact us at [email protected] or 254-910-5647. Carriers are not liable for delayed or undelivered messages.
